China Updates Visas & Residence Permit for Foreigners!
Today is the first day of June 2019. Meanwhile, a series of new laws and regulations will take effect across China since today. Let’s check how your daily life in China will be changed.

China Updates Visas and Residence Permit
China is to update its foreigner visa, group visa and residence permit from June 1. Bureaus of exit and entry administration across the country will in the meantime stop issuing the current versions of the foreigner visa, tourist visa to special economic zone, group visa and residence permit.
The new foreigner visa and residence permit cards will also feature a color profile picture of the holder.

Three Major Telecom Operators Cut Fee

Driving License Test Can Be Taken Nationwide
The Ministry of Public Security launched 10 new measures from June 1, including:

Car driving license test can be taken nationwide. Applicants can apply for a small car driving license directly in any place in the country with ID card, and no longer need to submit a residence registration certificate.

Applicants who apply for a small car driving license have passed some of the subject tests and have changed their place of residence to work outside of the country due to work, study, life, etc., can apply for change of the test place and continue to participate in the remaining subject test.

Applicants who apply for a large and medium-sized vehicle driver’s license in a different province (district) can apply directly with their ID card, and no need to submit a residence registration certificate.

Motorcycle annual inspection can be done nationwide. On the basis of the implementation of the national inspection of automobiles, the motorcycles will be further released across provinces. At the same time, motorcycles registered for less than 6 years are exempt from inspection by inspection agencies.

Civil Servants Can Retire Early
The revised Civil Service Law will come into effect on June 1, 2019. Civil servants can retire early if they work for 30 years.
If a civil servant meets one of the following conditions, voluntarily submit an application and, with the approval of the appointment and dismissal authority, may retire early:

Working years are over 30 years;

The retirement age set by the state is less than five years away, and the working years are 20 years;

Other situations that meet the state’s regulations and can retire early.

Enterprise Customs Annual Report Must Be Submitted Before June 30
According to relevant regulations, the customs declaration unit shall submit the “Annual Report on Registration Information” to the Customs of the Registration Office before June 30 of each year.
Import and export enterprises that have already registered for customs registration before 2018.12.31, regardless of whether there is any import or export business in the previous year, should handle the annual customs report before 2019.06.30.

New Version of the Customs Power of Attorney
On April 28th, the China Customs Brokers Association issued a notice that a new version of the “Proxy Customs Power of Attorney / Entrustment Customs Agreement” will be issued. The old version will be abolished since June 1st.

In 1995, Thai Red Bull, Thai Tencel, and Huabin Group agreed to establish Red Bull Vitamin Drink (Thailand) Co., Ltd. to promote Red Bull in China. As a result, the Huabin Group has the right to operate the “红牛REDBULL” trademark in China, and the Red Bull trademark is one of its important promotion sales strategies.

Since then, the influence of Red Bull trademark has continued to grow in the Mainland. Eventually, China has become the largest sales market for Red Bull, with annual sales reaching 5 billion cans.
In 2009, the partner Yan Bin got rid of the control of the joint venture company, and newly established Huabin Investment Co. Ltd., using Red Bull’s exclusive trademark agency authorization, to get Red Bull’s sales in the Chinese market.
In 2016, the Red Bull trademark authorization period expired. Thai Red Bull filed a lawsuit against the Huabin Group on the grounds of infringement of trademark rights; more than 20 lawsuits have not ended in the final so far.

In recent years, sales of Red Bull have continued to decline due to trademark lawsuits. In 2015-2017, Red Bull China’s sales were 23.04 billion yuan, 21 billion yuan, and 19.6 billion yuan, up to 15%, -7% and -19% year-on-year.
Focusing on trade and brand development, there are lots of similar cases! Therefore, international trademark registration is an urgent task!
New Balance: Don’t wait
In the 1990s, the American brand New balance plans to enter the Chinese market and take the Chinese name 纽巴伦.
After investing a large amount of money for brand promotion, New balance discovered later that it has been registered as a trademark by others, and New balance must temporarily withdraw from the Chinese market.
In 2013, New Balance enabled 新百伦 to return to the Chinese market and made the same mistake without the professional search. The name 新百伦 was registered by others already.

In fact, 新百伦 was registered as a Chinese trademark by Chinese businessman Zhou Lelun as early as June 4, 2004.
Therefore, New Balance’s new brand name infringes Zhou Lelun’s trademark rights and compensates 98 million yuan.
Therefore, don’t wait! After spending a lot of money to promote the trademark, then finds that the trademark can not only be registered but also infringes the legal rights of the original trademark owner. It is painful.
What’s more, in July 2016, the Korean brand Hera entered the Chinese market, followed by a big wave of promotion. Everyone remembered that the Chinese translation was “赫拉”, but they could not register. “Hera” had to be renamed “赫妍”.

The sooner the trademark registration is better. The State Intellectual Property Office of China has issued a document reminding all traders to have a sense of registered trademarks.

Chinese law enforcement agencies on Tuesday launched an upgraded version of its national tip-off platform against gang crime.

Chen Yixin, a senior official with the commission and head of the national office against organized crime, said this at a press conference.

“The public can provide leads of gang crimes via various online channels, including the official website of the Commission for Political and Legal Affairs of the Communist Party of China Central Committee as well as its official WeChat and Weibo accounts,’’ Chen said.
According to Chen, the upgraded platform utilizes big data, model analysis, and cloud computing, among other digital methods, allowing the platform to compare the information of suspects, cases as well as key areas of the crackdown.
As the crackdown goes wider and deeper, some places are lacking clues on whitewashed and undiscovered gang crimes, while some other places are short of in-depth investigations for a large number of leads.

The establishment of the upgraded platform aims to meet the new needs of China’s crackdown on gangs and organized crimes, according to Chen.
The platform increases the mass participation by offering easy accesses on smartphone and computer, as well as detailed instructions and simplified reporting procedures for the public to provide leads.

It also enhances the accuracy of the crackdown by generating submitted clues and automatically processing data, which allows authorities in charge of gang crimes crackdown to better manage and deal with relevant cases and clues.
“The platform can not only dynamically monitor the process of relevant cases and the movement of vicious gangs but also summarise rules with big data to strengthen the continuity of the crackdown,’’ Chen said.
The original report platform was set up in February 2018 amidst China’s increased efforts to crack down on gang crime.
As of March 31, the platform had received over 190,000 leads on gang crimes from letters and phone calls.

In fact, Guangdong has issued Reward Method for The Public to Report Evils in 2018. A maximum reward of 200,000 yuan will be offered to anyone who reports illegal activities.
Besides, in late April, the Guangdong government held a press conference to announce the Incentive Method to Report Infringement of Intellectual Property Right, which is going to be officially implemented on July 1st, 2019.
