A malicious overdraft credit card with an amount of more than 50,000 yuan and less than 500,000 yuan will be recognized as a “large amount” of the malicious overdraft credit card stipulated by the Criminal Law. It will be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and will be fined for 20,000 yuan to 200,000 yuan.

If the amount is huge or there are other serious circumstances, the person shall be sentenced to a term of imprisonment of not less than five years and not more than ten years, and a fine of 50,000 yuan to 500,000 yuan;
If the amount is particularly large or has other particularly serious circumstances, the person shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment, and shall be fined 50,000 yuan to 500,000 yuan or confiscated property.
