Suspension on These Flights
 
The Civil Aviation Administration of China (CAAC) has issued “circuit breaker” directives on several airlines’ flights to China as some passengers on these flights have been tested positive for coronavirus. 
 
The involved domestic and overseas airlines include: 
  • China Southern Airlines 
  • Sichuan Airlines 
  • Iraqi Airways 
  • Air France 
  • Saudi Arabian Airlines 
  • Pakistan International Airlines 
  • El Al Israel Airlines 
  • Egypt Air

The list of airlines and flights that received the directives is as follows. If you’ve planned to fly to China in recent days and bought the tickets for the involved flights, please contact the airlines as soon as possible

On May 7, CAAC issued the circuit breaker directives on four flights. Among them, Iraqi Airways flight IA473 and Air France’s flight AF198 will be suspended for two weeks from May 24
 
On May 19, CAAC issued the directives on six flights. China Southern Airlines’ flight CZ6044, Saudi Arabian Airlines’ flight SV884, Pakistan International Airlines’ flight PK854 and Sichuan Airlines’ flight 3U8392 will be suspended for two weeks from May 24
 
Meanwhile, Air France’s flight AF198 and EL AL Airlines’ flight LY065 will be imposed a 4-week PLF limit of no higher than 40% on its operation respectively from June 7 and May 24
 

CAAC has adjusted suspension measures for China-bound flights.

From May, airlines found to carry five or fewer passengers testing positive will now be able to choose between two types of restrictions: frequency-based, or load factor-based.

Get to Know the Chinese Green Card!

The Permanent Residence Permit, or the Chinese “green card”, is a valid personal ID for foreigners who have obtained permanent residence status in China. 
 
Foreigners who hold valid passports and a Chinese green card are not restricted in the duration of their stay in China, and can also enter and exit China without a visa. It is valid for 10 years, or five years for foreigners under 18.

ELIGIBILITY
Foreigners applying for permanent residence in China must abide by Chinese laws, be in good health, have no criminal record and meet at least one of the following criteria: 
 

1

Made a direct investment in China resulting in stable operations and a good tax-paying record for three consecutive years
  1. Investment in any industry encouraged under the Catalogue for the Guidance of Foreign Investment Industries: at least $500,000;

  2. Investment in western China or any key county under poverty alleviation efforts or development program: at least $500,000; 

  3. Investment in Central China: at least $1 million; 

  4. Investment in China: at least $2 million.

Hold the post of deputy general manager, deputy factory director or above; or of associate professor, associate research fellow and other associate senior titles of professional post or above, or enjoying the equivalent treatment, for at least four consecutive years, with a minimum period of residence in China for three cumulative years within four years, and with a good tax-paying record

Made a great and outstanding contribution to China or being specially needed by China. 
 

4

Be the spouse or unmarried child under 18 years old of a person in above categories. 
 

5

Be married to a Chinese citizen or a foreigner with permanent residence status in China, for at least five years, with at least five consecutive years of residence in China and at least nine months of residence in China each year, and having stable source of subsistence and dwelling place. 
 

6

Be an unmarried person under 18 years old who comes to China to live with parents in China. 
 

7

Be at least 60 years old, with no direct relatives abroad and have sponsoring relatives in China, stayed in China for at least five consecutive years with at least nine-month residence in China each year, and have stable source of subsistence and dwelling place. 
The requirements may be different in different cities, so please consult the public security bureau of the city where you want to apply to know more about eligibility. 
 
For example, Guangzhou stipulates that in principle, applicants should be under 55 years old.
 
 
PROCESS TIME 
 
According to the Regulations on Examination and Approval of Permanent Residence of Aliens in China, the processing time is within 6 months from the date of receipt of the application.

Article 18. The public security authority should make a decision on whether or not to approve the applications for permanent residence in China filed by aliens within six months starting from the day of receipt of the applications.

China will implement regulation in crackdown on illegal fundraising

Starting on May 1, China will implement a regulation to prevent and handle illegal fundraising amid efforts to promote healthy economic development and maintain social stability. 

 

The new regulation will strengthen oversight in key areas. It will also prevent and defuse risks and protect the legitimate rights and interests of the people. 

For business registration management, the regulation forbids the inclusion of words meaning “financial”, “exchange”, and “wealth management”, to name a few, in the name and business scope of enterprises and self-employed individuals, unless otherwise stipulated by laws, administrative regulations and the State.

To support the crackdown on illegal fundraising, financial and non-banking payment institutions should report large-value and suspicious transactions as required, and analyze and identify related accounts having suspected association with illegal fundraising. 

 

According to the regulation, departments, when handling illegal fundraising cases, may close down business premises and seize assets involved, order individuals leading or assisting illegal fundraising to recover and sell related assets to repay illegally raised funds, and bar those accountable from leaving the country.

China has amended the Law of Animal Epidemic Prevention which will come into effect on May 1. The law covers all livestock and animals raised or captured by humans. 
 
According to the revised law, any person or organization who raises a dog must ensure the animal is routinely vaccinated, and register the vaccination certificate.

Also, when walking a dog outdoors, the dog should have a valid registration card attached to its collar, and it should be kept on a leash to prevent it hurting anyone or spreading diseases. 
 
There are some other significant measures in the amended law, including the stipulation that wild animals must undergo quarantine, the agricultural and wild animal protection departments of the State Council must co-work in making a quarantine regulation for wild animals, and so on.

It is reported that the system, named EUTMS, is the first official inquiry tool of international trademark information in China, and is capable of handling 100 active users simultaneously.

China has issued new regulations that clarify what counts as “necessary” personal information that mobile apps are allowed to collect from users. The regulation will come into effect on May 1. 
 
In a document introduced last month, the Ministry of Industry and Information Technology, the Ministry of Public Security and some other departments have listed clearly the necessary personal information that 39 categories of apps can collect.

On Wednesday, Civil Aviation Administration of China issued the Notice on Trial Implementation of Adjusting the Circuit Breaker Measures for Scheduled International Passenger Flights

According to the notice, the “circuit breaker” measures have been adjusted. Limiting passenger load factor operation will be accepted if 5 to 9 passengers from any single inbound flight operated by an airline are diagnosed as confirmed cases. 
 
The airline involved may choose circuit breaker measures or measures of limiting PLF operation: 
  • Circuit breaker measures: the flight in question shall be suspended for 2-week operation starting from the fourth week of its entry into China, and its incentive flight shall be canceled; 

  • Measures of limiting PLF operation: the flight in question shall be imposed a 4-week PLF limit of no higher than 40% on its operation starting from the fourth week of its entry into China, and its incentive flight shall be canceled.

WHAT IS ANNUAL REPORT?
 
According to the Interim Regulation on Enterprise Information Disclosure, an enterprise shall, from January 1 to June 30 each year, submit the annual report of the previous year to the administrative department for industry and commerce through the enterprise credit Information disclosure systems.

This process is known as annual reporting or annual inspection process. The system will close after the deadline and those who fail to submit the reports shall be fined and included into a list of enterprises with abnormal operations, which affect the business license renewal.

An enterprise set up and registered in the current year shall submit and disclose its annual report from the next year. 
 
In other words, business entities formed in or before 2019 are required to do annual reporting this year, including:

The reform will substantially increase the number of domestic air routes with market-based prices, and the mechanism for the market to determine prices will further strengthen, the CAAC said. 
 
This move will likely continue to tap domestic market demand and accelerate the recovery of the sector.

Shenzhen checkpoint to suspend operation of 24-hour service

The schedule for Shenzhen Bay Checkpoint to implement 24-hour border crossing service before the end of the year has been suspended due to COVID-19, the Shenzhen Municipal Office of Port of Entry and Exit announced on its official website.
 
Due to the risks of COVID-19, the border crossing time has been adjusted to 10 a.m. to 8 p.m. from the original 6:30 a.m. to midnight. 
 
Hong Kong and Shenzhen will develop and assess the 24-hour service appropriately under the overall situation of COVID-19 prevention and control, according to the website.

2 new intercity rail lines launched in Guangdong

Two new intercity railways officially began service in Guangdong on Monday, further facilitating the travel of local residents and tourists in the province. 
 
The Guangzhou-Qingyuan Intercity Railway Line, which reaches 38.2 kilometers, will help accelerate the economic integration of Guangzhou and Qingyuan.
The new line has six stations, including two at ground level and four elevated. Travel time is about 30 minutes for the whole journey.

The 22.6 kilometer-long Guangdong Donghuan Intercity Railway has four stations, including one at ground level and three underground. Loudspeakers to be banned in Shanghai metro

A new restriction on the use of loudspeakers in metros will take effect in Shanghai on Dec 1, according to Shanghai Metro on Wednesday. 
 
The posters about the new rules are already in trains. They also reiterate the rule that bans eating and drinking in carriages. 
 
The move has been supported by many netizens, some of whom have suggested that the rules be rolled out across the country.
 
Regarding the implementation of the rules, a staff member told local news portal ThePaper that passengers may alert the metro’s customer service when they notice any offenses being committed.

The schedule for Shenzhen Bay Checkpoint to implement 24-hour border crossing service before the end of the year has been suspended due to COVID-19, the Shenzhen Municipal Office of Port of Entry and Exit announced on its official website.
 
Due to the risks of COVID-19, the border crossing time has been adjusted to 10 a.m. to 8 p.m. from the original 6:30 a.m. to midnight. 
 
Hong Kong and Shenzhen will develop and assess the 24-hour service appropriately under the overall situation of COVID-19 prevention and control, according to the website.

The move has been supported by many netizens, some of whom have suggested that the rules be rolled out across the country.

Major Chinese commercial banks in Shenzhen, South China’s Guangdong Province, have started testing the application of the central bank-backed digital currency for months. Now the government plans to further promote the use of digital RMB.
 
On Thursday, the Shenzhen municipal government announced on Weibo that a digital currency trial program will be launched. It is a regular test in the process of research and development of the digital Chinese yuan.

The local government allows individuals in Shenzhen to take part in a lottery of 50,000 digital currency red packets totaling 10 million yuan ($1.49 million). The value of each red packet is 200 yuan. 
 
According to some media reports, the program is open to those who are in Shenzhen when they register, and allows them to register with their mobile phone numbers and identification cards.

Winners of the drawing will receive text messages giving instructions on how to download a digital yuan application, open a personal digital wallet and receive their red packets. 
 
From 6 pm, Oct 12 to 12 am, Oct 19, winners can pay by digital currency red packets — in the same as paying in cash — at 3,389 merchants in Luohu district of Shenzhen, Guangdong province. Having completed modifications for a digital yuan system, the merchants include supermarkets, retailers, restaurants and lifestyle services providers.

  • What are the conditions of registration? 
Those who register to take part in the lottery must meet both conditions as follows:
  1. Being in the administrative region of Shenzhen (including the Shenzhen-Shantou Special Cooperation Zone) when registering;
  2. Register with the mainland phone number and the second-generation ID card. 
  • Are migrant residents working in Shenzhen allowed to register? 
Yes, as long as they meet the conditions mentioned above.
 
  • Can those who are in the same family register at the same time?
Yes. Family members meeting conditions can register as individuals. 
 
  • Will I get the digital RMB red packet once after registration? 
After the registration, you need to take part in a lottery. Winners of the drawing will receive text messages giving instructions on how to download a digital yuan application, open a personal digital wallet and receive their red packets. 
 
  • When to register? 
The registration platform has been open since 0 am, Oct 9, 2020. Individuals in Shenzhen can register anytime before 8 am, Oct 11, 2020.
 
  • Are the red packets issued in batches? 
No. In this trial program, 50,000 digital RMB red packets will be sent at a time through drawing, which means that each individual who successfully registered has only one chance to win the lottery. 
 
  • How to check the result of the drawing? 
Winners of the drawing will receive the winning text messages. They can also check the result through the “i深圳” app or its official WeChat account. 
  • How to receive the red packets? 

The text messages will give instructions on receiving the digital RMB red packets. Winners can click the link within the message, following the instructions to download a digital yuan application, open a personal digital wallet and receive the red packets. 

 

They can also check the drawing result and the instructions via the “i深圳” app and its official WeChat account. 

 

  • Can I use the red packet directly after receiving it? 

 

Yes. The red packet can be used freely at 3,389 merchants that have completed the digital RMB system modification in Luohu district. It’s just like using cash. 

 

The merchants include supermarkets, retailers, restaurants and lifestyle services providers.

The Hong Kong Special Administrative Region (HKSAR) government is planning to introduce “health code” system that allows quarantine-free travel among Hong Kong, Guangdong province and Macao SAR when Hong Kong’s COVID-19 outbreak situation stabilizes. 
 
Matthew Cheung, chief secreatry for administration of the HKSAR government, said on Sunday in his blog that Hong Kong is discussing with the mainland and Macao to allow holders of certifications of negative result of the nucleic acid test on COVID-19 to be exempted from compulsory quarantine on arrival in the three places under the “health code” system.

This arrangement, however, will only be implemented when the epidemic stabilizes in Hong Kong, Cheung said, adding that the HKSAR government will continue to take preventive and control measures with caution and the public are urged to stay vigilant in face of the epidemic. 
 
Meanwhile, the HKSAR government is studying to allow Hong Kong residents from mainland who possess related certifications to be exempted from compulsory quarantine, which has entered the final stage, Cheung said.
 
To get prepared for the fourth wave of the epidemic which may appear in winter, the construction of quarantine facilities in Hong Kong is in full swing.

Michael Wong, secretary for development of the HKSAR government, said on Sunday in his blog that after the first phase of Penny’s Bay quarantine camp in the New Territories was put into operation in mid-July, the construction of the second phase was completed in mid-September. 
 
Wong said that the construction work of the third and fourth phases are progressing smoothly and is expected to be completed by the end of 2020, when the total number of quarantine unites in Hong Kong will exceed 4,000.

The HKSAR government has also commenced construction of a temporary hospital and community treatment facility, with the support of the central government. The Chinese central bank PBOC has launched large-sum cash management trials in northern China’s Hebei province, as part of a two-year pilot scheme that will also involve Hangzhou and Shenzhen.

The Hebei trials involve the imposition of cash management requirements starting from 100,000 yuan for personal accounts and 500,000 yuan for business accounts
 
This means that whenever individuals make cash withdrawals of 100,000 yuan or more, or institutions make cash withdrawals of 500,000 yuan or more, they will need to make appointments and registration in advance. 
 
They will also be required to clearly note the usage of the withdrawals and the sources of deposits, as well as enter this information into a large-sum cash management system. 
 
“In actual life, a 100,000 yuan starting point for large-sum cash management of private accounts will not markedly affect the daily economic activity of the public,” said a PBOC representative in Shijiazhuang as reported.

Following the launch of trials in Hebei, they will be extended to Zhejiang province and Shenzhen municipality starting from October 10. 
 
The thresholds of cash management for business accounts in Zhejiang and Shenzhen are also 500,000 yuan, while the thresholds for personal accounts are respectively 300,000 yuan and 200,000 yuan
 
In addition, Zhejiang has further regulated and restricted large-sum cash transactions of four industries, including wholesale and retail industry, automotive industry, real estate industry, as well as building and construction industry.

It is reported that the government has set the top limits of accumulative large-sum cash withdrawals per day for the above-mentioned industries as follows: 
 
  • Wholesale and retail industry – 600,000 yuan 
  • Automotive industry – 600,000 yuan 
  • Real estate industry – 1,500,000 yuan 
  • Building and construction industry – 3,000,000 yuan 
If the cash withdrawal exceeds the limit, bank will not process in principle. For those who need to withdraw money over the limit, they are required to submit materials proving the purpose of withdrawals. 
 
Anyway, the regulations will not significantly affect normal daily economic acitivities as multiple payment alternatives are readily available.

China has implemented a measure requiring passengers from several countries to obtain COVID-19 negative certificates before boarding. Now the list is expanded to 32 countries, let’s check the updates! 

Starting from July 21, passengers to China meeting the following conditions are required to take nucleic acid tests for COVID-19 within five days before boarding and present the negative results: 
 
  • Passengers from the specific countries on the list
  • Passengers transfer via the listed countries

The list of countries where China-bound passengers are required to obtain COVID-19 negative certificates has been adjusted since we posted the relevant article last week. 
 
We found that there are 20 more countries added to the list so far, most of which are African countries. That means, China’s entry measures have covered African countries and we can see more of our foreign friends soon!

On August 10, Chinese Embassy in Denmark released a notice, saying that foreigners from some countries with valid residence permits are allowed to apply for Chinese visa for free to enter China. Here’s the full content.

Visa Facilitation for Some Foreign Nationals with Valid Chinese Residence Permits
In view of the rapid spread of COVID-19 across the world, China has decided to temporarily suspend the entry into China by foreign nationals holding visas or residence permits still valid to the time of the announcement effective from 28 March 2020. Meanwhile, foreign nationals traveling to China for necessary economic, trade, scientific or technological activities or out of emergent humanitarian needs may still apply for visas.
 
As the prevention and control of COVID-19 become regular, in order to facilitate exchanges, China now decides that, foreign nationals from the countries listedbelow who hold valid residence permits, including work permit, permit for family reunion and personal matters,may apply for visas for free at any Chinese embassy or consulate in these countries. After entering China, they are kindly requested to comply with the epidemic prevention regulations of the local governments.

Starting from July 27, people who arrive in Shanghai from overseas can spend half of their quarantine time at home if certain conditions are met. Please pay attention to the latest policies if you plan to come to China via Shanghai. 
Shanghai announced on Thursday it will allow some overseas arrivals to complete 7 days of their 14-day quarantine period at home starting on July 27; however, the first 7 days of their quarantine must be completed at designated locations.

△ Shanghai Gov announced the new quarantine measures on its official Weibo account. 
Travelers are required to take a COVID-19 nucleic acid test on the 5th day of their quarantine at a designated location and they must have a fixed residence in the city if they decide to finish the last 7 days of quarantine at home. 
 
If they return a negative nucleic acid test result, the authority will allow them to finish their quarantine at home, without coming into contact with other persons in the transfer process. 
Before their quarantine ends, the traveler and other members in the same household must take nucleic acid tests. The quarantine will be lifted after the 7 days if all tests are returned negative. 
 
However, the returnees must accept the rules on home isolation; that is, there must be only one person in the household, or the other members in the same household must remain in isolation with the returnee during their quarantine period.

What if I don’t meet the conditions? 

 
Those who are unwilling or unable to meet these conditions must accept the 14-day quarantine at a designated location. 
 
 
Is it applicable to travelers heading to other places? 
 
Travelers whose final destination is the neighboring Zhejiang, Jiangsu and Anhui provinces will also be allowed to follow the same “7+7” procedure. 
 
Those who are heading to other cities, however, will be required to complete their 14-day quarantine in Shanghai.

What if I cannot quarantine at a designated location? 
 
If travelers are unable to quarantine at a designated location; for example, elderly persons, minors, pregnant women and disabled individuals, they can apply for home-based isolation if they can submit negative nucleic test results and meet the relevant home-based isolation rules.

In addition, China requires passengers on flight to China to provide negative nucleic acid test results before boarding. So if you plan to fly to Shanghai from overseas and want to apply for the “7+7” quarantine, you will undergo nucleic acid test three times during the whole period: 
 
  1. Before boarding, you need to complete COVID-19 nucleic acid test within 5 days
  2. On the 5th day of the quarantine, you can take the test for the second time and apply for the home quarantine. 
  3. Before the home quarantine ends, you need to take the test again. The quarantine will be lifted if all the results are negative.

Passengers on flights to China are required to provide negative nucleic acid test results before boarding, the country’s civil aviation regulator said Tuesday. Are you planning to come to China in recent days? Check the updates! 
NEW RULES FOR INBOUND PASSENGERS
 
Chinese and foreign passengers taking flights to China must present their negative results of COVID-19 nucleic acid tests before boarding, the Civil Aviation Administration of China said in a joint statement issued with the General Administration of Customs and the Ministry of Foreign Affairs. 
 
The move aims to ensure the health and safety of international travelers and reduce the risks of cross-border spread of the pandemic.

According to the statement, specific arrangements are as follows: 
 
1. Chinese and foreign passengers on China-bound flights shall complete COVID-19 nucleic acid tests within 5 days before boarding. Tests shall be carried out in facilities designated or recognized by overseas Chinese Embassies or Consulates. 
 
2. Chinese passengers are required to take photos of and upload their negative results of COVID-19 nucleic acid tests using the international version of the health QR code mini program on WeChat.

3. Foreign passengers should apply with the Chinese Embassies or Consulates for the Health Declaration Letter with negative test results of COVID-19. 
 
4. Relevant airlines are responsible for checking passengers’ health QR codes and Health Declaration Letter before boarding. Passengers will be denied boarding if they fail to meet relevant requirements. All airlines shall strictly follow the checking procedures.

5. Passengers who provide false documents and information shall undertake corresponding legal liabilities. 
6. Chinese Embassies will carefully evaluate the nucleic acid testing capabilities of the countries of their residence and issue specific implementation measures as appropriate. 
 
 
MORE AIRLINES TO RESUME FLIGHTS
More international airlines are resuming flights to Guangzhou and other Chinese cities including Shanghai and Nanjing. Here are some airlines’ latest flight schedules. 
 
  • Egypt Air
EgyptAir will resume flights to and from Guangzhou on July 23, once a week. A Boeing 773 will be flying this route.

Breaking! An Ethiopian Aircraft Erupts into Flames at Shanghai Airport

An Ethiopian Airlines Boeing 777F has caught fire at Shanghai Pudong airport while cargo was being loaded. 

The carrier says in a statement that the aircraft is registered ET-ARH and was on a regular scheduled cargo service from Shanghai Pudong to Sao Paolo, and onward to Santiago. 

The aircraft was only carrying freight so no passengers were on board, however there is no information as to any injuries to crew or staff on the ground.

Videos and photos on social media show a large part of the freighter’s aft section burnt away. While the fire’s cause is unknown, the footage indicates that it has been brought under control.

01 WORK WITHOUT PERMITS
 
Leo loves traveling around the world. During his trip to China with a tourist visa, he happened to know an international private school was recruiting foreign teachers, so he applied for the job and successfully got it. 
 
As a result, Leo was caught by the police officers. He and the school were fined 5,000 yuan and 10,000 yuan respectively.

Exit and Entry Administration Law of the People’s Republic of China

Article 41 Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who have no work permits or work-type residence permits.

Article 80 Foreigners who work in China illegally shall be fined not less than RMB 5,000 but not more than RMB 20,000 yuan; where circumstances are serious, they shall be detained for not less than five days but not more than fifteen days and shall also be fined not less than RMB 5,000 yuan but not more than RMB 20,000 yuan.

 
 
02 THE MULTITASKING STUDENTS 
 
Luke is an international student, but he didn’t go to school after obtaining a student visa. He was hired as a salesman and went to five kindergartens to teach, with a monthly salary of 8,000 yuan. 
 
Luke was sentenced to administrative detention for 10 days and was fined 10,000 yuan. The institution that hired him and the kindergartens were also fined 10,000 yuan, and their illegal gains were confiscated.

Exit and Entry Administration Law of the People’s Republic of China

Article 43 Any of the following acts of foreigners shall be deemed unlawful employment:

(1) Work in China without obtaining work permits or work-type residence permits in accordance with relevant regulations;

(2) Work in China beyond the scope prescribed in the work permits; or

(3) Foreign students work in violation of the regulations on the administration of foreign students working to support their study in China and work beyond the prescribed scope of jobs or prescribed time limit.

Article 80 Item 3 Individuals or entities that illegally employ foreigners shall be fined RMB 10,000 yuan for each illegally employed foreigner, with a cap of RMB 100,000 yuan in total; and the illegal gains, if any, shall be confiscated.

 
03 WORK BEYOND THE SCOPE
 
A performance team of 10 foreigners went to S province for dance performances with the approval by the provincial culture department and the Approval of Short-term Employment for Foreigners Working in P.R. China, while the scope of their performances was limited in Y city.
 
In order to increase income, the team leader privately contacted an agency to add another show in N city. 
 
The police officers find it out during the performances. In the end, the team and the agency were fined 50,000 yuan respectively and their illegal gains were confiscated.

Exit and Entry Administration Law of the People’s Republic of China

Article 43 Any of the following acts of foreigners shall be deemed unlawful employment:

Article 80 Item 2 Persons who introduce jobs to ineligible foreigners shall be fined RMB 5,000 yuan for each job illegally introduced to one foreigner, with a cap of not more than RMB 50,000 yuan in total; and entities that introduce jobs to ineligible foreigners shall be fined RMB 5,000 yuan for each job illegally introduced to one foreigner, with a cap of RMB 100,000 yuan in total; and the illegal gains, if any, shall be confiscated.

04 STAY & WORK ILLEGALLY
 
Peter got a part-time job with a monthly salary of more than 6,000 yuan during his studies in China. He was soon noticed by the police and was fined and ordered to exit China within a prescribed time limit.
 
However, Peter was bitter about the punishment. He didn’t leave as required and, on the contrary, worked again. A month later, he was caught again, being sentenced to administrative detention for 15 days and was repatriated. He was not be allowed to enter China for three years.

Exit and Entry Administration Law of the People’s Republic of China

Article 62 Item 1&3 Under any of the following circumstances, foreigners may be repatriated:

(1) Are ordered to exit China within a prescribed time limit but fail to do so;

(2) Are involved in circumstances in which they are not allowed to enter China;

(3) Illegally reside or work in China; or

(4) Need to be repatriated for violation of this Law or other laws or administrative regulations. 

Repatriated persons shall not be allowed to enter China for one to five years, calculating from the date of repatriation.

 
05 REPLACE THE APPROVED LIST
 
A performance team has organized 30 performers for a symphony concert in N city and obtained the relevant permit according to law. Before the performance, the police checked the performers’ documents and found that there were 20 performers not on the performance list. What’s more, the visas that nine of the other 10 performers held were tourist visas. 
 
In other words, only one performer in the team complied with the regulations. The police immediately halted the show.

Relevant Handling Procedures for Foreign Nationals’ Entry into China to Perform Short-Term Work Assignments

Article 4 Foreign performing groups and individuals coming to China for short-term commercial performance shall hold an approval document from Chinese government authorities for cultural affairs and the Approval of Short-Term Employment for Foreigners Working in the P.R.China; those coming to China for other short-term work assignments shall have an Alien Employment License and employment certificate.

Guangzhou has rolled out preferential individual income tax (IIT) policies in Guangdong-Hong Kong-Macao Greater Bay Area. From July 1 to August 15, eligible applicants can submit an application online.

Last year, Guangdong issued a Notice on Implementing the Individual Income Tax Preferential Policies in the Guangdong-Hong Kong-Macao Greater Bay Area (“the GBA”), which sets out the general framework for determining eligibility and extent of an individual income tax subsidy. 
 
Guangzhou later rolled out a series of interim measures for the policies and recently released the application guidance with some FAQs. Let’s check the details!

What’s the main content of Guangzhou’s subsidy policy? 
 
The Interim Measures stipulate that overseas high-end talents and critically lacking talents who work within the administrative area of Guangzhou shall be given financial subsidies if their IIT paid in Guangzhou exceeds the tax amount computed at 15% of their taxable income. 
 
The subsidies are granted on a lump-sum basis every year. It will be open for application and granted after the settlement and payment of IIT in the following year. 
 
The period of IIT settlement in 2019 is between March 1 to June 30, 2020. And the applications for financial subsidies in 2019 are accepted from July 1 to August 15 this year

How to calculate the financial subsidy? 
 
Where an applicant earns incomes under Article 10 of the measures, the applicable annual financial subsidy shall be computed with the following formula: 
 
Financial subsidy=∑ (IIT balance by category each year × the proportion of IIT paid by category) 
 
The proportion of IIT paid by category = the amount of IIT paid by category in Guangzhou each year ÷ the amount IIT paid by category in China each year.

Who are eligible for the subsidy? 
 
  1. The overseas high-end talents conform to the standards of the Catalogue of Overseas High-end Talents in Guangzhou.
  2. The overseas critically-lacking talents conform to the Catalogue of Critically-lacking Talents in Guangzhou, and the taxable income of IIT in the tax year shall exceed RMB 300,000
Meanwhile, the applicants mentioned above need to meet the following conditions:
 
  1. The applicant shall be a permanent resident of Hong Kong or Macao, a Hong Kong resident under the Hong Kong’s Admission Schemes for Talents, Professionals and Entrepreneurs, a Taiwanese resident, a foreigner, or a returned overseas Chinese or a returned overseas Chinese student who has obtained the right of long-term residence abroad; 

     

  2. The applicant shall work or be employed by enterprises and other institutions registered in Guangzhou during the tax year, or alternatively provide independent personal services in Guangzhou, work in Guangzhou for a minimum of 90 days during the tax year, and pay IIT in Guangzhou according to law; 

     

  3. Within three years before applying for financial subsidies, the applicant shall have no information records of major tax violations, no records of dishonest acts such as false reporting, false collection, fraud, misappropriation of financial funds, violation of scientific research ethics and integrity, and no records of serious violation of laws or regulations, such as being included into the blacklist of debtors for law enforcement, being subject to criminal punishment or ordered to suspend production or business, being revoked of the business license or permit, or receiving administrative punishment involving large sum of fine. The applicant is not directly or primarily responsible for the above acts or records of the withholding agent, nor is he the legal representative or responsible person of the withholding agent.

For overseas hight-end talents:

  2. Applicant’s valid identity certificate 
  3. Confirmation documents of the applicant’s qualification 
  4. Materials to prove that the applicant’s annual working days in Guangzhou reach a minimum of 90 days
  5. Commitment Letter for IIT Financial Subsidy
  6. Materials to prove that the applicant is enlisted in talents projects
  7. Power of attorney
For overseas critically-lacking talents: 
  1. Application Form for IIT Financial Subsidy from the applicant 
  2. Applicant’s valid identity certificate
  3. Materials to prove that the applicant’s annual working days in Guangzhou reach a minimum of 90 days 
  4. Materials to prove that the applicant’s academic degree skill, qualification, and so on 
  5. Commitment Letter for IIT Financial Subsidy 
  6. Materials to prove that the applicant is enlisted in talents projects 
  7. Power of attorney
Must the applicant have both the A-type work permit and the confirmation letter for foreign high-end talents? 
 
No. The eligible applicant holding any of them can enjoy the financial subsidies.

  2. Arrival card for temporary entry foreigners (144-hour visa-free transit) filled out;

  3. Onward ticket to a third country (or region) with confirmed departure time and seat within 144 hours of arrival, which can be an air, sea or train ticket

 

Q3: How long does the whole process take?

It will take about 10 minutes during passenger-flow rush hours.

 

Q4: When do the 144 hours of visa-free stay start?

After confirming your qualification for the 144-hour visa-free transit, you will get a temporary entry permit from the immigration inspection station. Then from 00:00 of the next day upon your arrival in China, you can stay within the designated area without a Chinese visa for a maximum of 144 hours (6 days).

 

Q5: Under what circumstances are foreigners not allowed a temporary stay permit?

Under any of the following circumstances, foreigners will not be issued a temporary stay permit by exit/entry border inspection authorities:

 

  1. Circumstances in which entry is not allowed in accordance with laws or administrative regulations;

  2. Valid period of passport or other international document is less than three months, or there is a previous rejection stamp from China’s visa-issuing authorities;

  3. Have a record of illegal entry into or exit from China, illegal residence or illegal employment in the past five years;

  4. Have violated regulations on accommodation registration under serious circumstances over the past two years.

☉If foreigners need to stay in the designated areas beyond the 144 hours due to uncontrollable circumstances, they should immediately notify and apply to the exit/entry administration department of the public security bureau for corresponding stay permits.

 

☉Foreigners who fail to remain in the designated area or fail to leave within the specified time limit, to exit from designated ports or process accommodation registration, will be punished by exit/entry border inspection authorities or the local public security bureau according to the law.

  • If the foreign individual leaves China for more than 30 days consecutive a year, the period of continuous residence of more than 183 days in China will be counted anew.

The General Administration of Customs has issued a notice. From May onwards, for the entry of passengers with pets, eligible for 30 days of isolation immunity, but only dogs or cats (one per person per time.)

Three types of inbound pets exempt from quarantine include: 

  • Pets from 19 designated countries or regionsNew Zealand, Australia, Fiji, French Polynesia, Hawaii, Guam, Jamaica, Iceland, United Kingdom, Ireland, Liechtenstein, Cyprus, Portugal, Sweden, Switzerland, Japan, Singapore, Hong Kong, Macao.

Japan’s ministry of foreign affairs has announced that from May, it will start online visa application service for Chinese tourist agencies to Japan. What is the IIT subsidy for talents in GBA?
 
Overseas high-end talents and overseas critically-lacking talents who work within the administrative area of Guangzhou shall be given financial subsidies if their IIT paid in Guangzhou exceeds the tax calculated at 15% of taxable income. The subsidy is exempt from IIT. 
 
The computation of the balance of the IIT shall be based on one tax year, which begins on Jan 1st and ends on Dec 31st of the Gregorian calendar.

What are the IIT paid in GZ referred to in the Measures?
The “taxes paid” refers to IIT paid for the following income streams in accordance with the Individual Income Tax Law of the People’s Republic of China
 
  • Wages and salaries; 
  • Income from remuneration for personal services; 
  • Income from author’s remuneration; 
  • Income from royalties; 
  • Business operating income; 
  • Subsidized income from talent projects or talent programs administered by governments, governmental departments or institutions directly affiliated with governments at the district level or above.

How to calculate the subsidy?
 
Financial subsidies shall be ranted in a lump sum based on categorized IIT computation (comprehensive incomes shall be computed with comprehensive method).

The annual settlement and payment shall be handled and have been handled according to the tax law
Where the categories of individual incomes belong to comprehensive income or income from business operation, which shall be settled and paid in accordance with the provisions of the tax law, the paid amount of IIT shall be based on the actual amount of tax paid in the whole year after the settlement and payment procedures of tax refund/arrears in the following year.

The tax law stipulates that there is no need for annual settlement
 
If the individual income is not subject to settlement under the tax law, the amount of IIT paid shall be based on the actual amount of tax paid in the whole year after tax refund/arrears payments.

What is the computation formula?
IIT balance = IIT paid – taxable income × 15% 

Annual financial subsidy = ∑ (IIT balance by category each year × the proportion of IIT paid by category × subsidy period coefficient)

 

Note:  

The proportion of IIT paid by category = the amount of IIT paid by category in GZ each year ÷ the amount IIT paid by category in China each year

 

Subsidy period coefficient = taxable income for the period entitled to financial subsidies ÷ taxable income for the whole year

Computation of IIT balance of residents
 

① Resident comprehensive income categories (including four categories i.e wages and salaries, incomes from remuneration for personal services, authors remuneration and royalties) 

 
IIT balance = the amount of IIT paid on comprehensive income – the amount of taxable comprehensive income × 15%
 

② The category of income from business operation 

 
IIT balance = the amount of IIT paid on income from business operation – the amount of taxable income from business operation × 15%
 

③ The category of subsidies obtained by being enlisted in talents projects

 
IIT balance = the amount of IIT paid on subsidies obtained by being enlisted in talents projects – the amount of taxable income from subsidies obtained by being enlisted in talents projects × 15%

Computation of IIT balance of non-resident individuals
 

① The category of wages and salaries of non-residents 

 
IIT balance = the amount of IIT paid on wages and salaries – the amount of taxable income from wages and salaries × 15%

China and France have signed an agreement allowing mutual recognition and exchanges of the two countries’ driving licenses. The agreement has been effective from Aug 17.

△ LE SERRE, a French citizen, got a Chinese driving license right after the agreement came into effect. 

 
China and France have signed an agreement allowing mutual recognition and exchanges of the two countries’ driving licenses, according to the Ministry of Public Security (MPS). 
 
Under the deal, which has come into effect on Aug 17, China and France will allow holders of valid driving licenses issued by either authority to drive directly or obtain driving permits without an additional test
 

No Need for Extra Test! CHN to Recognize French Driving Licenses

 
To be specific, people staying in the other country for less than a year will have their driving licenses recognized in the destination country, while those staying for more than a year can exchange their original licenses for local ones without separate tests. 
 
Reciprocal treatment will be applied to students who study in each other’s countries. 
 
According to, only French driving licenses issued after Sept 16, 2013 (in new European format) can be recognized and exchanged in China.

The agreement was signed to facilitate people’s travel by driving in the two countries, and further encourage bilateral trade cooperation and people-to-people exchanges, said the MPS.
 
It is reported that the authorities will further expand the scope of mutual recognition. China has mutually recognized driver’s licenses with the United Arab Emirates UAE and Belgium and inked such an agreement with Serbia.

Hong Kong announced on Tuesday that the boarding, quarantine and testing requirements for persons arriving from overseas will be tightened from Friday. Let’s check the details! 
Effective from Today! Overseas Arrivals Face Stricter Measures!
 
Hong Kong decided to tighten health quarantine arrangements on inbound travelers from 16 countries to fend off the more infectious Delta coronavirus variant. 
 
Effective from 12:00 a.m. on Friday (August 20), travelers from 15 countries, including the United States, France and Spain, will be required to be fully vaccinated and undergo a 21-day quarantine upon arrival, according to a statement of the Hong Kong Special Administrative Region government (HKSAR). Those countries will be upgraded from the medium-risk category to high risk. 
 
Australia will be moved from low risk to medium risk so that non-vaccinated visitors from the country have to undergo quarantine for 21 days and those fully vaccinated will be quarantined for 14 days, or seven days with a positive antibody test. 
 
Effective from Today! Overseas Arrivals Face Stricter Measures!
The decision to tighten quarantine arrangements was to strengthen the local barrier against the importation of the virus in view of the recent surge of infections with the Delta variant overseas, the government spokesperson said. 
 
Here’s the category of relevant overseas places and the relevant risk-based arrangements:
 
Group A
 

Effective from Today! Overseas Arrivals Face Stricter Measures!

Persons who have stayed in Group A specified places on the day of boarding for/arrival at Hong Kong or during the 21 days before that day can only board flights for Hong Kong if they are Hong Kong residents (HKRs) who are fully vaccinated and hold a recognized vaccination record
 
The boarding and quarantine requirements applicable to Group A specified places remain unchanged but the number of tests will be increased. 
 
Details will be as follows: 
 
  • Undergo compulsory quarantine for 21 days in a designated quarantine hotel (DQH); 
  • Undergo six tests during compulsory quarantine; 
  • Self-monitor for the subsequent seven days; and 
  • Undergo compulsory testing in a CTC on the 26th day of arrival at Hong Kong. 
Group B
Effective from Today! Overseas Arrivals Face Stricter Measures!
For HKRs who have stayed in Group B specified places on the day of boarding for/arrival at Hong Kong or during the 14 days before that day (the relevant period), but have not stayed in Group A specified places, the relevant quarantine requirements will be as follows: 
 
  • Undergo compulsory quarantine for 21 days in a DQH; and 
  • Undergo six tests during compulsory quarantine. 
 
Effective from Today! Overseas Arrivals Face Stricter Measures!
Relevant non-HKRs who do not hold a recognized vaccination record are not allowed to board flights for Hong Kong. 
 
As regards relevant HKRs and non-HKRs who are fully vaccinated and hold a recognized vaccination record, their quarantine period can be shortened upon arrival. 
 
The relevant quarantine and testing requirements will be as follows: 
 
  • Undergo compulsory quarantine for 14 days in a DQH; 

  • Undergo four tests during compulsory quarantine; 

  • Self-monitor for the subsequent seven days; and 

  • Undergo compulsory testing on the 16th and 19th days of arrival at Hong Kong, where the test to be taken on the 19th day must be conducted in a CTC. 

Group C
 
Effective from Today! Overseas Arrivals Face Stricter Measures!
For HKRs and non-HKRs who have stayed in Group C specified places during the relevant period, but have not stayed in Group A or Group B specified places, the relevant quarantine requirements remain unchanged yet the compulsory testing requirements will be enhanced. 
 
Details will be as follows: 
 
  • Undergo compulsory quarantine for 14 days in a DQH; 
  • Undergo four tests during compulsory quarantine; 
  • Self-monitor for the subsequent seven days; and 
  • Undergo compulsory testing on the 16th and 19th days of arrival at Hong Kong, where the test to be taken on the 19th day must be conducted in a CTC. 
As regards relevant HKRs and non-HKRs who are fully vaccinated and hold a recognized vaccination record, their quarantine period can be shortened upon arrival. 
 
Effective from Today! Overseas Arrivals Face Stricter Measures!
 
Besides the requirement of recognized vaccination records and the enhanced testing requirements, the relevant quarantine requirements remain unchanged. 
 
Details will be as follows: 
 
  • Undergo compulsory quarantine for seven days in a DQH; 
  • Undergo two tests during compulsory quarantine; 
  • Self-monitor for the subsequent seven days; and 
  • Undergo compulsory testing on the 9th, 12th, 16th and 19th days of arrival at Hong Kong, where the test to be taken on the 19th day must be conducted in a CTC.

On August 4, CAAC issued circuit breaker directives on three flights. Iraqi Airways’ flight IA473 will be suspended for 2 weeks from Aug 16. China Southern Airlines’ flight CZ350 and flight CZ6044 will be suspended for 2 weeks, respectively from Aug 9 and Aug 30, 
 
On Aug 5, CAAC issued a circuit breaker directive on Kenya Airways’ flight KQ882. The flight will be suspended for two weeks for Aug 9.

On Aug 12, CAAC issued circuit breaker directives on multiple overseas and domestic airlines. Air China’s flight CA180 will be further suspended for two weeks from Aug 23, and the flight CA722 will be suspended for two weeks from Aug 16. 
 
Both China Southern Airlines’ flight CZ348 and Air China’s flight CA908 will be further suspended for two weeks from Aug 16. 
 
As for overseas airlines, Aeroflot’s flight SU208 will be suspended for two weeks from Aug 16. Kenya Airways’ flight KQ882 will be further suspended for two weeks from Aug 23.

On Aug 12, CAAC issued circuit breaker directives on two flights of Air China. The flight CA180 will be further suspended for two weeks from Sept 6, and the flight CA942 will be suspended for two weeks from Aug 12. 
 
On Aug 13, CAAC issued circuit breaker directives on three flights. Air China’s flight CA934 will be suspended for two weeks from Aug 16. Myanmar Airways International’s flight 8M711 will be suspended for two weeks from Aug 23. 
 
Kenya Airways’ flight KQ882 will be further suspended for two weeks from Aug 30.
